- These Terms of Use are set forth by the Committee for Collaboration among Kanazawa’s Three Central Commercial Districts (the “Company”), regarding use of the services provided through this website (the “Service”). The Service is provided to all users (the “users”) for use in accordance with these Terms of Use.

- Extent of Applicability

These Terms of Use shall apply for all relationships between users and the Company related to use of the Service.
In addition to these Terms of Use, the Company may stipulate other rules and regulations regarding use of the Service (“specific provisions”). These specific provisions shall constitute a part of these Terms of Use, regardless of name.
In the event of any inconsistencies between the provisions of these Terms of Use and any specific provisions, the specific provisions shall take priority unless explicitly specified in the specific provisions.

- Prohibitions

In using the Service, users are prohibited from the following:
Acts that violate laws and regulations, or that go against public order and morals
Acts related to criminal activity
Infringements on copyrights, trademarks, or any other intellectual property rights of the Service or included within the Service
Destroying or otherwise interfering with server(s) or network(s) belonging to the Company, other users, or other third parties
Commercial use of information obtained via the Service
Acts that could interfere with the Company’s operation of services
Unauthorized access or attempts to gain unauthorized access
Collecting or otherwise accumulating personal information regarding other users
Use of the Service for any unauthorized purpose
Acts that cause loss, damages, or discomfort to other users
Impersonation of another user
Advertising, publicity efforts, solicitations, or any other business activities on the Service not authorized by the Company
Efforts to meet unfamiliar members of the opposite sex
Acts related to the Company’s services that directly or indirectly benefit antisocial forces
Any other acts deemed inappropriate by the Company

- Suspensions or Interruptions to Provision of the Service

The Company reserves the right to suspend or interrupt all or part of the Service, without prior notice to users, for any of the following reasons:
Maintenance inspections of, or updates to, computer systems related to the Service
If it becomes unfeasible to provide the Service due to force majeure such as earthquakes, lightning strikes, fires, power outages, or natural disasters
If there is a computer or transmission line outage due to an accident
Any other circumstance in which the Company deems it unfeasible to provide the Service
The Company assumes no liability for any losses or damages experienced by users or third parties due to a suspension or interruption to provision of the Service.

- Restrictions on Use and Termination of Registrations

The Company reserves the right to restrict user access to all or part of the Service and/or to terminate user registration, without prior notice to the user, in any of the following cases:
Violations of any stipulation of these Terms of Use
Any other circumstance in which the Company deems use of the Service to be inappropriate
The Company assumes no liability for any damages experienced by users as a result of actions taken by the Company in accordance with this article of the Terms of Use.

- Disclaimer of Warranty and Disclaimer of Liability

The Company makes no de facto nor de jure warranty, neither expressly nor implicitly, that the Service shall be free of defects (including safety, reliability, accuracy, integrity, validity, applicability to a given purpose, flaws related to security, errors or bugs, or infringement of rights).
The Company assumes no liability for any damages experienced by users caused by the Service, with the sole exception of cases of willful or gross negligence on the part of the Company. Provided, however, that this disclaimer shall not apply in the event that a contract between the Company and the user regarding the Service (including these Terms of Use) is considered a consumer contract, as defined in the Consumer Contract Act.
Even in the case provided in the preceding paragraph, the Company assumes no liability for damages experienced by a user due to a debt default or unlawful act arising from the Company’s negligence (excluding gross negligence), including damages due to special circumstances (including cases in which the Company or the user could or should have foreseen the damages occurring). Furthermore, compensation for damages experienced by a user as a result of a debt default or unlawful act arising from the Company’s negligence (excluding gross negligence) shall be limited to the amount paid by the user in usage fees for the month during which the relevant damages occurred.
The Company assumes no responsibility for any transactions, communications, nor disputes between users and other users or third parties in connection with the Service.

- Changes to Service Content

The Company reserves the right to change, add, or discontinue Service content, with prior notice to users; users consent to such changes, additions, or discontinuations.

- Modifications to the Terms of Use

The Company reserves the right to modify these Terms of Use, without requiring individual user consent, in the following cases:
When modifications to these Terms of Use are in accordance with the general interest of users
When modifications to these Terms of Use are not contrary to the purpose of the Usage Agreement of the Service, and are reasonable in light of the necessity of the change, the suitability of the specifics of the change(s), and other circumstances pertaining to the change(s)
When modifying these Terms of Use in accordance with the preceding paragraph, the Company shall notify users in advance of the fact of Terms of Use being modified, of the modifications being made, and of the date when the modifications come into effect.

- Governing Law and Jurisdiction

These Terms of Use shall be governed by and construed in accordance with the laws of Japan.
In the event that any dispute arises concerning the Service, the court with jurisdiction over the location of the Company’s headquarters shall have exclusive jurisdiction.
